Please read these Terms of Service carefully before using the Scanna AI app. These Terms govern your access to and use of our mobile application and services.
Acceptance of Terms
By downloading, installing, or using the Scanna AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.
Eligibility
You must be 18 years of age or older (or the legal age of majority in your jurisdiction) to use Scanna AI.
By using the App, you represent and warrant that you meet this age requirement and that your use of the App complies with all applicable local, state, and federal laws, including laws governing cannabis use in your jurisdiction.
Scanna AI is intended for use only where cannabis is legal. It is your responsibility to know and comply with the laws of your jurisdiction.
Educational & Informational Use Only
Scanna AI is an educational and informational tool only. The App provides product data, lab information, terpene profiles, and AI-generated responses for informational purposes.
The App does not provide medical advice, diagnosis, or treatment recommendations. Nothing in the App should be construed as medical advice or a substitute for consultation with a qualified healthcare provider.
Always consult your healthcare provider and a licensed budtender before making decisions about cannabis use, particularly if you have a medical condition or take prescription medications.
Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any jurisdiction where cannabis is illegal
- Use the App for any commercial purpose without our prior written consent
- Attempt to reverse engineer, decompile, or disassemble any part of the App
- Use the App to transmit harmful, offensive, or unlawful content
- Interfere with or disrupt the integrity or performance of the App
- Attempt to gain unauthorized access to any part of the App or its systems
AI-Generated Content
The App includes an AI-powered advisor ("Terpy") that generates responses based on your inputs and scan history. AI-generated content is provided for informational purposes only and may not always be accurate, complete, or up to date.
Scanna AI is not responsible for any decisions made based on AI-generated content. You should independently verify any information before acting on it.
Label scans and chat conversations may be processed by third-party AI providers (including ClaudeAI by Anthropic) to generate responses. By using these features, you consent to this processing as described in our Privacy Policy.
Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Scanna AI and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
User-Provided Content
Any content you voluntarily enter into the App (such as journal entries, ratings, or preferences) remains yours. By entering such content, you grant Scanna AI a limited license to use it in anonymized, aggregated form to improve the App's functionality and recommendations, as described in our Privacy Policy.
You are solely responsible for any content you enter and represent that it does not violate any third-party rights or applicable laws.
Disclaimers & Limitation of Liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Scanna AI does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Product data, lab results, and AI responses may contain inaccuracies and should not be solely relied upon.
TO THE FULLEST EXTENT PERMITTED BY LAW, SCANNA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
Indemnification
You agree to indemnify, defend, and hold harmless Scanna AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
Third-Party Services
The App may integrate with or rely on third-party services (including AI providers, analytics platforms, and hosting infrastructure). Scanna AI is not responsible for the practices or content of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the App will immediately cease.
Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved in the appropriate courts of competent jurisdiction.
